Compensation Victims Can Recover After a Car Accident in Illinois
Medical expenses are one of the most common types of compensation victims can recover after a crash. These claims may recover costs for hospital visits, surgeries, medication, and physical therapy. Claims can also include future treatment needs, such as long-term care.
Victims may also recover lost income when injuries prevent them from working. This compensation can cover missed days, reduced hours, or the inability to return to the same job. Some claims also account for future earning limitations caused by lasting injuries.
Another type of compensation victims can recover focuses on restoring or replacing damaged items. This typically covers vehicle repair costs or the fair market value of a totaled car. Claims may also include personal belongings that were inside the vehicle.
Pain and suffering damages reflect the physical discomfort and personal impact of an injury. These damages can address ongoing pain, limited mobility, or disruptions to daily activities, compensating for the non-financial effects of a crash.
In rare cases involving egregious or extreme conduct, punitive damages may apply. Courts award these damages to hold parties accountable for reckless behavior. They are not awarded in every case, as they depend on specific circumstances.
Insurance claims often involve delays, disputes, or settlement offers that fail to cover actual losses. Adjusters may question medical records or the extent of injuries during their review. Some claims also take longer due to repeated requests for documents or additional evaluations.
An auto accident attorney can review medical records and explain all available legal options. An attorney can also handle all communication with insurance companies during the claims process.
