Who May Be Responsible for a Turning Motorcycle Crash in Fox Lake, IL?
A driver who turns across the path of an approaching motorcycle may potentially be responsible for the resulting crash if the driver's actions violated traffic laws or otherwise contributed to the collision. Determining liability generally requires looking at how both vehicles were moving and what the available evidence shows.
Traffic signals, right-of-way rules, visibility, roadway conditions, and the timing of the turn can all be relevant in a turning collision. Photographs, crash reports, witness statements, and available video may provide additional information about what each driver was doing before the impact and whether any factors contributed to the crash.
The rider's injuries can also affect the losses involved in a potential claim. Hospital treatment, rehabilitation, medications, follow-up care, and other medical expenses may become significant. At the same time, serious injuries can lead to missed work, reduced earning capacity, and other financial difficulties during recovery.
Because these losses can extend beyond medical treatment, insurance coverage should also be reviewed. Information from the vehicles' insurance policies, medical records, repair estimates, and other documentation may help identify available coverage and establish the expenses and losses connected to the crash.
Once the available evidence and records have been gathered, a personal injury lawyer can review the situation and explain how liability and potential damages may be evaluated. An attorney may also help organize medical and financial documentation, review insurance coverage, and identify additional information that could be relevant to a potential claim.
